My answer to the judge's comment is the danger was not obvious. Occasional spa users may not be aware of some of the dangers hot water poses. The Nevada government and the hotel-casino did not do their homework on hot tub safety involving these unfilled large jetted tubs. Excessive consumption of alcohol and soaking in this large jetted tub too long with water temperatures at or above 110 degrees F are the three key ingredients for causing drowsiness which leads to hyperthermia causing unconsciousness and drowning. This information is with the Consumer Products Safety Commission for over 25yrs...Read More

Do you think it would be reasonable to put a $1 sign there, talking about the hazards of drinking and intoxicants when you have a bar located a few feet from this tub in this hotel suite? Answer from health inspector at the wrongful death jury trial. "As a safety concern, yes, it could be prudent to do some kind of warning, but it's not required." During the wrongful death jury trial, a comment the judge made to council was "I absolutely can't possibly see how you're going to prove that the actions of failing to post a sign where the government doesn't require a sign to be posted, and whatever danger there exists from using the jetted tub is certainly as obvious to the user of the tub as to the hotel, and the hotel did not act with any consious disregard of people's safety."
